I am writing to request your strong opposition to S.25.

This legislation would grant to the FDA the statutory authority to impose civil monetary penalties against any individual or organization for filing a petition with the agency, under the Administrative Procedures Act (APA). As written, the bill contains no clarifications on the criteria to be used by the FDA to justify its own decision that a filed petition is based on false evidence. The bill would restrict the current right under the APA to freely petition the FDA to change a policy or challenge regulatory decisions, or even review its own actions.

I strongly urge you to oppose this legislation. I appreciate your consideration of my views and look forward to knowing your position.
