The FDA’s determination to ban ephedrine alkaloid containing dietary supplements at every dose level is a political decision. By statute and consistent with adulteration case law, FDA had to limit its ban to those dose levels demonstrated to present a significant or unreasonable risk of illness or injury. Instead, it banned ephedrine at every dose level in supplements (but completely exempted ephedrine alkaloid containing foods). The FDA had no scientific evidence in its 133,000 page record that ephedrine alkaloids at 20 mgs or less presented a significant risk of illness or injury. Consequently, it relied instead on a hypothetical model from a Dr. Mario Inchiosa. Paid by FDA to do this, Inchiosa wrote FDA 3 letters in which he hypothesized a potency comparison between the drug epinephrine (intravenously injected) and the drug ephedrine (intravenously injected). Although those substances differ in their effects upon the body, making a dose comparison improper, and although intravenous injection of a substance is not a proper comparison to oral ingestion of it and the drug ephedrine is not the same as ephedrine alkaloids in the herb ephedra, Inchiosa presumed all appropriate equivalents. He then concluded that ephedrine alkaloids consumed in 1.5 mg amounts every four hours continuously would produce toxicity. Those three letters are the sum total evidence FDA had to ban all ephedrine alkaloid containing dietary supplements at 20 mg or less ephedrine alkaloids. It is junk science, and it is proof that politics reigns over science in this area. The precedent established is devastating.
