The Dietary Supplement Health and Education
Act (DSHEA) has been federal law for over ten years. Even
after four successful federal court decisions vindicating
consumers' rights to have access to truthful health claims
on supplements and in advertising products, the FDA and the
Federal Trade Commission (FTC) continue to censor and engage
in heavy-handed attempts to restrict access to supplements
and educational information.
H.R.4282, the Health Freedom Protection Act,
introduced by Congressman Ron Paul and supported by seven
other Representatives, seeks to redress this abuse by these
two federal agencies. The bill would stop the FDA from
censoring truthful claims about the curative, mitigative, or
preventative effects of dietary supplements. It would
prevent the FDA from prohibiting the distribution of
scientific articles and publications to consumers regarding
the role of nutrients in protecting against disease. It
would also prevent the FTC from censoring truthful health
claims by requiring supplement manufactures to satisfy an
unobtainable standard of proof that a health claim statement
is true.
